CARP HUNTERS EUROPE ANGLER (CUSTOMER/BOOKING ORGANISER) TERMS AND CONDITIONS 

1 Carp Catfish Hunters Europe Limited are acting as booking agents for the fishing, travel & accommodation providers (“Providers”). We do not offer “package holidays” as we merely arrange for you to contract independently with the various providers.

2 On receipt by us of your deposit we will reserve your holiday at your chosen venue. Your deposit is accepted as part payment towards the total cost of the holiday. Deposits are strictly non-refundable.

3 Your booking is only confirmed on receipt of your non-refundable deposit for each person. The booking organiser will receive an invoice to confirm your booking, and this will also show the outstanding balance and the date this is due by. The booking organiser will receive a receipt for any payments made at any given time. The Booking Organiser accepts these Terms & Conditions on behalf of his or her party.

4 The booking organiser confirms that he/she is at least 18 years old and has supplied us with correct details (including name, date of birth, address, email address, contact numbers,) of everyone in the party. Customers that are under the age of 18, are not allowed to travel with Carp Hunters Europe unless they have a parent or legal guardian with them, due to travel and safeguarding legislation. If a customer under the age of 18 is travelling and have a legal guardian with them, the booking organiser must submit in writing proof of legal guardianship.

5 The booking organiser confirms that he/she has the authority of all other persons included in the party to make the booking on their behalf, that he/she accepts these terms and conditions for himself and them and has provided a copy of these terms and the other contractual information to all members of the party. We will only deal with the booking organiser.

6a The balance of the cost of the holiday less any monies paid must be paid no later than 12 weeks before departure (the “balance due date”). If you book within 12 weeks of departure you must pay the total cost of your holiday at the time of booking.

6b If payment of the balance is not received by us in cleared funds by the balance due date, we may cancel your booking.

7a Cancellation of a booking will only be accepted in writing from the booking organiser. The following cancellation refunds will apply unless the relevant Provider’s terms state otherwise:

7b More than 84 days’ notice, you will receive 50% of any monies paid, minus nonrefundable deposit of £200 per person

7c Less than 84 days’ notice, no refund available

7d In the event of any difference from the Providers’ terms we will impose their cancellation charges plus an administration fee of £50.

7e In the event of being able to resell your booking, we may be in a situation to offer you a further partial refund. 7f Any refunds given will be paid 30 working days after refund has been agreed in writing by Carp Catfish Hunters Europe Limited and the booking organiser.

8 Quoted prices include VAT and may be increased or decreased to reflect changes in taxes and other levies.

9 Requested changes to the booking will be accommodated if, when and where possible and there will be an administration charge from us.

10 Occasionally we may inform you of changes to your arrangements. Most changes are minor, for example a change to a ferry time. In the case of a minor change, we will advise you at the earliest possible date. If we have to make a major change, for example a change to another lake, you will be given the choice of accepting the change to the arrangements or cancelling the holiday with a full refund of all monies paid.

11 Occasionally we may inform you of changes of prices for food and bait packages provided by the fishery. This is completely out of Carp Catfish Hunters Europe Limited’s control. The booking organiser will be informed and be given the choice of either opting out of having a food package if price increases are unacceptable, as well as bait packages from the fishery. Please note that some fisheries have compulsory bait that has to be bought on site. Carp Catfish Hunters Europe Limited will provide the booking organiser at time of booking of the food package and bait package prices for your chosen venue.

12 All members of the party must have a valid UK/EU passport. Refunds are not available if permission to travel is denied by border authorities. If travel is denied by boarder authorities, each person will be responsible for their own travel arrangement from this point onwards.

13 Travel – Any travel arrangements made for you by Carp Catfish Hunters Europe Limited are subject to the published conditions and regulations of the carrier. We are unable to guarantee that you will depart at the times specified, and we do not have any liability to you for any delay or inconvenience. As with all the Providers we contract on your behalf and the Providers, not us, are responsible to you for the provision of the relevant service and you are responsible to them for compliance with their terms and conditions. We will provide copies of their terms and conditions upon request.

14 Force Majeure: We will not be liable for loss or delay occasioned by any of the following: Strikes, Riots, Political Unrest, Hostilities, War or threat of War, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical/Weather problems to transport, Closure of Ports, Weather conditions or any other event(s) beyond our control.

15 Carp Catfish Hunters Europe Limited strongly recommends that you purchase personal travel and, if driving, vehicle breakdown insurance.

16 Data Protection

(a) We process the personal data of all members of the party and may transmit it to the Providers: to enable us and them to process your bookings and comply with the terms of our respective contracts with you. We have no control over such data once it has been passed to a Provider. In connection with the storage and use of images as referred to in clause 17.

(b) Any member of the party may obtain from us details of their personal data held by us and we will correct it if requested.

(c) We will delete the non-photographic data of your party members once six years has elapsed since they last took a trip organised by us. Photographic data will be retained indefinitely.

(d) Until the booking organiser withdraws consent, we will use his/her personal data for sending promotional material on fishing holidays.

(e) Our data processing activities are overseen by the UK Information Commissioner’s Office. If you have a complaint about our processing it should be addressed to the ICO.

17 Images. From time-to-time party members may provide us with photographs of themselves or other members of the party (whether directly or by posting them on social media to which we have access). If those photographs concern the activities of the party whilst on a holiday organised by us, we will assume that the photographer and persons depicted in them have granted us consent to reproduce those photographs in any medium to publicise our business and those of the Providers. Those consents can be withdrawn at any time by written notice to us.

18 Jurisdiction: Acceptance of these Terms & Conditions constitutes acceptance of a contract on these terms subject to English Law and the exclusive jurisdiction of the English Courts.

19 Indemnity: Booking organiser agrees that he or she is responsible for the behaviour of all members of his or her party and agrees to reimburse Carp Catfish Hunters Europe Limited all their costs and losses suffered by Carp Catfish Hunters Europe Limited in connection with a claim by a Provider, a member of the party or any third party and arising from any act or omission of a member of the party.

20 Complaints Procedure: In the unlikely event that you or a member of your party has a complaint about your holiday;

(a) Whilst at the venue – the complaint must be notified to the owner / bailiff in the first instance and then Carp Catfish Hunters Europe Limited by telephone. You must give the owners and / or Carp Catfish Hunters Europe Limited a chance to resolve your complaint whilst you are at the venue. 


(b) On return – unresolved complaints must be sent in writing and with photographic evidence, if possible, to Carp Catfish Hunters Europe Limited within 7 days of your arrival back in the UK.

(c) Except in extra-ordinary circumstances we will not deal with complaints first made after the end of the holiday.

21 Liability: Carp Catfish Hunters Europe Limited is only providing a booking service. We are not providing accommodation, fishing, and in most cases food packages. and we are not liable for the failure of any of those things unless caused by our negligence or breach of contract. Where applicable our liability is limited by relevant international conventions and treaties covering the provision of travel and accommodation services.

21a The booking organiser is responsible for making sure that you and your group arrive in plenty of time from your outward-bound pick-up point. Carp Catfish Hunters Europe Limited will not be held responsible for customers arriving late and our vehicles will leave at the agreed time 1 month before you travel date in order for us reach ferry/train points on time. The booking organiser is responsible for ensuring all passports are up to date, are with you at the time of travel, as well as any necessary travel documents you for entry of the chosen venue European destination. Carp Catfish Hunters Europe Limited will not be held responsible for customers not being ready to leave on time for inbound journey.

21b The booking organiser is responsible for ensuring you and your group understand the legalities for what you can and cannot take into your chose venue country. Strictly do not take any illegal substances, or any other contraband, (goods that are illegal to import or export). Carp Catfish Hunters Europe Limited will not be held responsible for any customs or boarder control intervention if stopped for any customer.

21c Taking your own bait to France. As much as we appreciate anglers like to take their own bait on a trip to Europe as a company we have to uphold and abide by the law. Since leaving the EU you can NOT bring any meat or dairy products into France or other EU countries, from outside the EU. This includes boilies as these contains dairy products ie eggs or milk derived ingredients Should you choose to take your own bait please bear in mind each person has a weight allowance. All luggage is clearly marked with each customer’s name and customers are fully responsible for what their luggage contains. We do not search any customers luggage. Carp Hunters Europe Limited accept no responsibility for the transportation of bait. Should the vehicle be stopped, searched and bait be found and confiscated this is entirely at the customer’s own risk. Customers will be fully responsible for any fines incurred and any costs to Carp Hunters Europe Limited.

22 COVID-19: To confirm, should the UK or any European government impose restrictions allowing customers to not enter due to Covid:19 pandemic, your booking will be moved to a future date. Usually, the same time the following year, or sooner. We will discuss this at the time with you. Our agreement with the lake owners is that no refunds are allowed. In case of the above, if boarders are open and the booking organiser or group decide not to travel our cancellation policy will apply. 21 Disabled Travellers; our aim is to provide a high level of service to all our customers. However, we are not a specialist operator in the field of holidays for the disabled. The majority of the fishing venues and accommodation that we offer is not suitable or equipped for the needs of many disabled people. Therefore, if any member of your party has any relevant disability we must be informed at the time of booking when we will do our best to help and advise.

23 Every venue has their own Fishery Rules. Many are common sense and not unlike rules that apply to venues in the UK. It is the booking organisers responsibility to make everyone in the party aware of the fishery rules BEFORE they make a booking. It is the booking organisers responsibility to check before departing of any rule changes at the fishery and to make any members of their booking aware of these changes. Anyone found to be breaking any of the fishery rules may be asked to leave and your holiday will be terminated without compensation. Excessive consumption of alcohol or taking of illegal substances will not be tolerated or accepted at any venue. You may be asked to leave if you are found to have consumed excessive amounts of alcohol or have taken illegal substances. If you or your party are asked to leave the venue, you will be responsible for arranging your own travel arrangements for return travel and no refund will be given by Carp Catfish Hunters Europe Limited.

24 A security deposit may be required when you arrive at a venue. This should be refunded in full subject to deductions for any breakages and the fishery is left in an unreasonable state. Our venues are well run, and we would ask that you leave them in the same clean state as you found them.

25 Boats may be available at the venue. The use of boats is entirely at your own risk. Boat hire or loan is not included in any of our packages. If you wish to use a boat, its loan or hire would be a separate contract between you and the person hiring or loaning the boat. Everyone using a boat MUST use a lifejacket and ensure adequate safety precautions are taken at all times.

26 All venues are primarily fishing venues; they may not be suitable for children. Persons taking children are reminded that they do so entirely at their own risk. Adults are responsible for the safety and behaviour of their children. Extra care should always be taken near water.
